NewMent Inc. runs Pixaaa and respects copyright. If you think a photo or listing stored on Pixaaa infringes your copyright, send a notice to our designated agent and we'll look at it. This page follows the Digital Millennium Copyright Act, 17 U.S.C. 512.

Pixaaa publishes listings to marketplaces such as eBay, Shopify, Etsy and Pinterest. For a listing that is live on one of those sites, you should also use that marketplace's own reporting process, since we can only remove what we host.

Sending a takedown notice

Under 17 U.S.C. 512(c)(3), your notice must be in writing and include:

  1. a physical or electronic signature of the copyright owner or someone authorized to act for them;
  2. a description of the copyrighted work you say is infringed (or a list, if there are several);
  3. the material you say infringes, with enough detail for us to find it, such as a URL or listing ID;
  4. your name, mailing address, phone number and email;
  5. a statement that you believe in good faith the use is not authorized by the copyright owner, its agent or the law;
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

A notice missing these items may not be valid. Knowingly misrepresenting that material infringes can make you liable for damages under 17 U.S.C. 512(f).

What happens next

When we get a valid notice we remove or disable the material and tell the user who uploaded it, including a copy of the notice.

Counter-notice

If your material was removed and you believe that was a mistake or misidentification, you can send our agent a counter-notice. Under 17 U.S.C. 512(g)(3) it must include:

  1. your physical or electronic signature;
  2. the material that was removed and where it appeared before removal;
  3. a statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification;
  4. your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where NewMent can be found), and that you will accept service of process from the person who sent the original notice or their agent.

We forward the counter-notice to the person who filed the original notice. If they don't tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material within 10 to 14 business days after we received the counter-notice.

Repeat infringers

We close the accounts of users who repeatedly infringe copyright, in appropriate circumstances. We count valid notices that weren't successfully countered, and we may close an account after a single notice if the infringement is clear and deliberate.
